Man producing fake Alomo Bitters arraigned by NAFDAC in Lagos

One Akintunde Smith was on Tuesday arraigned before the a Federal High Court in Lagos by the National Agency for Food and Drug Administration and Control, NAFDAC, for allegedly unlawfully manufacturing Kasapreko Alomo Bitters.

The suspect who had no legal representative pleaded not guilty to the charges when they were read to him.

NAFDAC prosecutor, Umar Shamaki while testifying before the Court said the accused committed the offence around January 15 2015 at No 8 Omotara Street in Aguda area of Lagos State.

Smith was arraigned on a three-count charge relating to the offence which contravened section 1 of the Food, Drugs and Related Products, Registration, Act, Cap F33, Laws of the Federation of Nigeria, 2004 and punishable under section 6 (1) of the same Act.

The NAFDAC prosecutor argued that, “The offence is also contrary to section 1 (a) of the Unwholesome Processed Foods (Miscellaneous Provisions) Act, Cap C34, Laws of the Federation of Nigeria, 2004 and punishable under section 3 (1) (a) of the same Act.”

According to him, the suspect after manufacturing the beverage allegedly labelled it Kasapreko Alomo Bitters, which also violates section 5 (a) of the Food and Drugs Act, Cap F32, Laws of the Federation of Nigeria, 2004 and was liable to be punished under section 17 (1) of the same Act.

Abang, the trial judge, who adjourned the case till May 6 and 7, urged Smith to get a legal representative to defend himself, adding that he could apply for bail pending when he get himself a legal representation.

The trial judge, however, directed that the accused to be remanded in prison.
