A Kaduna State High Court has sentenced one Mahmud Muhammed, 22, to two years imprisonment, for raping a nine-year-old girl.
Muhammed was dragged before Justice Hanatu Balagun, in 2013, on a one-count charge of rape, punishable under section 283 of the Penal Code Laws of Kaduna State, 1991.
According to the prosecution counsel, Dari Bayero, the accused, who was 18 at the time of committing the crime, had, in Oct. 2013, lured his victim, a nine-year-old minor, resident at Unguwan Kanawa, Kaduna, to his house and forcefully had sex with her against her will.
“He has therefore committed an offense of rape, punishable under section 283 of the Penal Code Laws of Kaduna State 1991,” Bayero, Director of Public Prosecution in Kaduna State Ministry of Justice told the court.
The defense counsel, Biba Franklin of the Legal Aid Council, appealed for leniency, saying that the accused was a first offender and a young person.
In her judgement, Justice Balagun, said that the prosecution counsel had proved his case beyond reasonable doubt.
“The evidence before this court, particularly your confessional statement accepting to have committed the crime, and the medical report, which indicated sexual assault on the victim, is overwhelming.
“I, therefore, sentence you to two years in prison without option of fine, ” Balogun ruled.
