An FCT High Court in Jabi, Abuja, on Wednesday sentenced a soldier,
Kabiru Abdullahi, to death by hanging for killing one Musa Tanko.
Abdullahi was a private in the Nigerian Army when he committed the crime.
He was found guilty of stabbing Tanko to death with a knife.
Abdullahi was charged on one count of culpable homicide, punishable with death under Section 221 of the Penal Code.
Justice Ugochukwu Ogakwu while delivering judgment, said the testimony of the witness regarding what transpired between the convict and the deceased was “credible” and clearly showed the guilt of the convict.
Ogakwu said the convict intentionally and with the knowledge that death or grievous bodily injury would be the probable consequence of his action, stabbed the deceased in the neck.
“I, therefore, find and hold that the prosecution has established the guilt of the accused person as charged.
“I accordingly find the accused guilty as charged on the sole count of the culpable homicide,” Ogakwu said.
NAN recalls that a witness, Cpl Solomon Samson, had told the court that the convict was arrested and taken to the crime branch of the Zuba Police Station by Insp. Ogbeh Godwin.
He said Godwin, who was on special duty in Madalla in Niger, reported that the convict had killed someone.
Samson said he visited the scene of crime where he saw a young man, identified as Musa Tanko, lying in a pool of blood.
He told the court that the corpse was moved to the Gwagwalada Specialist Hospital where the deceased was confirmed dead.
Samson said a confessional statement of the convict was recorded where he admitted committing the offence. (NAN
