A Mobile court sitting in Ondo west local government area of Ondo State has jailed 83 year-old man, Mr. Saliu Oteniya for nine months with hard labour.
He was convicted for defecating around his house without providing a toilet.
The same court, also pronounced nine months imprisonment with hard labour on 15 landlords arrested for different environmental offences in the community.
Government Prosecutors, Mrs. Elizabeth Akinfemisoye and Mr. Olarewaju Adegoke, particularly accused the octogenarian of committing an offence that is capable of causing disease outbreak in the community.
Oteniya, who is the landlord of a building located at 23 Lokun Street in Owo, was also accused of encouraging his tenants in the same act.
While addressing the court on the offences of other landlords, the Prosecutors said they failed to provide sanitary dustbins and latrine in their houses, since the existing ones were filled up.
The prosecutors also told the court that such act was liable to cause disease outbreak in and around the places.
According them “they have failed to renovate the dilapidated buildings of their houses and failed to provide sanitary latrine and bathrooms in their places of domicile, since the existing ones are unsanitary and exposes the users.”
The Prosecutors said that the offenses were contrary to sub-section O, Part II cap 52′ of environmental sanitation law of Ondo State 2004.
The Presiding Magistrate, Mr. Odenusi Fadeyi sentenced the landlords, including the Octogenarian to nine months imprisonment each with an option fine of N15,000 in lieu of the sentence.
The Magistrate who also emphasized the need for a sanitary latrine and bathroom in a place of domicile, mandated all the landlords in the facilities in their places of abode.
