The Justice Cornelius Akintoye-led three-man panel of the House of Assembly Election Petition Tribunal sitting in Umuahia, the Abia State, has dismissed the petition against the member representing Ohafia South constituency, and the current Deputy Speaker of the State Assembly, Rt. Hon. Ifeanyi Uchendu.
The dismissal came following a notice of motion for withdrawal filed by the petitioner (Kalu), asserting that he hurriedly approached the tribunal with the hope of assembling the unit election documents with the result sheets, which he claimed, he was unable to do on time.
The petitioner, affirmed that after gathering his figures, it was clear that the respondent (Uchendu), won the election outrightly.
Delivering his ruling, Justice Akintoye, granted the application of the petitioner, and however, struck out the matter.
Recall that the All Progressives Congress(APC), House of Assembly for Ohafia South state constituency, Anya Inyima Kalu, had on 30th day of March, 2019, filed a petition, challenging the emergence of Hon. Ifeanyi Uchendu, as the duly elected member in the March 9th House of Assembly poll conducted at Ohafia local government area.
In the suit No: EPT/AB/HA/15/2019, the APC candidate (petitioner), prayed the court to nullified the poll, which produced the respondent (Uchendu), as the winner.
