Contrary to the judgement of a Federal High Court Abuja on the status of Rt. Hon. Aminu Tambuwal as the Speaker of the House of Representatives, a governorship aspirant on the platform of the Peoples Democratic Party, PDP in Lagos State, Mr. Adegbola Dominic yesterday said the position of the Speaker of the House was now vacant, since he has defected to the All Progressives Congress, APC. Adegbola said the defection has rendered Tambuwal’s membership of the lower chamber of the National Assembly void.
Dominic, in an interview with Daily Independent, said in accordance with Section 68 (1) of the Nigerian Constitution, Tambuwal has ceased to be a member of the House the day he defected to APC.
He also urged members of the House to reconvene and elect a new Speaker.
“Tambuwal should have resigned honourably. The fact that some people have defected before and did not lose their position does not mean it is right. I believe the IGP should have waited for him to resign before withdrawing his security details or wait for the House to reconvene and remove him as the Speaker. The constitution allows them to do that if there is emergency.”
“Officially now Tambuwal is not even a member of the House. With that, the position of the Speaker is now vacant. There is no Speaker in the House. The man who is meant to be the Speaker has lost that seat. That is why the members should reconvene and choose a new Speaker. It is not a matter of removing the Speaker, they are reconvening to elect a new Speaker,” he stated.
Dominic also faulted the action of the Acting Inspector General of Police in withdrawing Tambuwal’s security details, describing it as premature since he was yet to resign and a new Speaker is yet to be elected to replace him.
