Supreme Court grants appellants prayers in Ekiti Obaship tussle

Supreme Court panel presided over by Acting Chief Justice of Nigeria, Justice Walter Onnoghen, has granted the prayers of a contender to the stool of the Alara of Aramoko Ekiti, Prince Olusegun Aderemi, in a matter before it.

Prince Aderemi has in a motion prayed the Apex Court to raise additional grounds of appeal and as well canvass fresh point of law in the matter before.

The Appellant also sought leave of the court to amend the original notice of appeal by incorporating the additional grounds of appeal as exhibit “C” attached to the affidavit in support of the application.

The Onnoghen-led panel on January 31, 2017 granted Aderemi’s motions as prayed saying, “Leave is hereby granted appellant to raise additional grounds of appeal and to canvass fresh point of law in this appeal”.

The Onnoghen-led Supreme Court panel also granted Aderemi leave to amend the original notice of appeal by incorporating the additional grounds of appeal as exhibit “C” attached to the affidavit in support of the application.

The matter, SC/143/2015, between Prince Aderemi (appellant) and Prince Olu Adeyemi and the Attorney General of Ekiti State (respondents) whereby Aderemi is challenging the process of selection of Adeyemi as monarch of the community, came up on January 31, 2017 at the Supreme Court.

While ruling on a motion filed by Aderemi in the matter, the Onnoghen-led panel further, “ordered that appellant be and is hereby granted leave to amend the original notice of appeal by incorporating the additional grounds of appeal as exhibit “C” attached to the affidavit in support of the application within seven days to this order”.

While Ademola Adesina appeared as counsel for Prince Aderemi, Ayodeji Esan appeared for Prince Adeyemi and Ekiti State Attorney-General.

Justices Musa Muhammad, Kudirat Kekere-Ekun, Ejembi Eko and Sidi Bage sat alongside the acting CJN.

The legal tussle began at an Ijero Ekiti High Court in 2009 with suit number before it moved to the Appeal Court, Ado Ekiti Division. The suit number is CA/EK/93/2013.
