A Chief Magistrate Court sitting in Makurdi, the Benue State capital, has ordered for substituted service on a former Lagos State Commissioner of Police, Alhaji Abubakar Tsav in a criminal suit filed against him by the State Attorney General and Commissioner for Justice, Mr. Michael Gusa.
The court, presided over by Isaac Ajim, gave the order on Monday after listening to an application brought to it by counsel to the complainant, Barrister Andrew Wombo, which sought leave of the court to effect service on the accused via substituted means.
The complainant was granted leave to paste the service of criminal summons on the last known address of the accused at Amadu Comassie Street, beside St. Augustine Catholic Church, Demekpe, Makurdi, Benue state.
The service of criminal summons would also be pasted on the notice board of Chief Magistrate Court I, Makurdi, Benue State.
It would be recalled that the state Attorney General had initiated criminal prosecution against Alhaji Tsav in suit No:DCR/226C1/ 2018, brought pursuant to section 143 (C), (D) and (E) of the criminal code law of Benue state, 2004.
Alhaji Tsav had been accused of writing a letter to the Governor of Benue State, Samuel Ortom, captioned “Whistle Blowing: Stagnation of Benue State,” which was copied to the presidency and anti-graft agencies.
The letter, according to the complainant, was also published in Nigerian Concord and contained injurious falsehood against the Governor and government of Benue state.
The accused is reported to have been evading service, hence the application for substituted service on him.
