Nyako’s prosecution: Justice Abang admits 108 documentary evidence

Justice Okon Abang of the Federal High Court in Abuja on Tuesday admitted 108 documents tendered at the resumed hearing of prosecution of former governor of Adamawa State, Murtala Nyako and his son, Senator Abdul-Aziz Nyako.

This was at the request of the the prosecution, the Economic and Financial Crimes Commission (EFCC).

The trial which was monitored by DAILY POST, showed that the prosecution witness, Suleiman Mohammed, a staff of FSDH Merchant Bank, Abuja testified that those documents tendered contained detailed transactions of Tower Asset Management and Blue Ribbon Multilink.

“My Lord, as requested by the prosecution counsel, I hereby tender all documents relating to this case”, Suleiman averred.

Responding, Counsel to Murtala Nyako, Ibrahim Ishaku, who stood in brief for Kanu Agabi (SAN) earlier rejected ‎documents 16,17.18, 58,59, and 37 as tendered by the prosecution counsel Rotimi Jacobs (SAN) arguing that they were not certified by the appropriate officers as public ‎documents.

Rotimi Jacobs added that accepting merely endorsed documents by FSDH merchant Bank officials would amount to abuse of court processes, while insisting that ‎document 90 has no reference to the accused.

Justice Okon Abang, ruling on the admissibility of the documents stated that the evidence so tendered by prosecution counsel on 16,17,18,58, and 59 be accepted as exhibit B1 B36, E38 and 127 as attached evidence to the documents.

Meanwhile, he rejected document 37 while he admitted document 90 as part of evidence.
