Nigerian govt. reacts to suit seeking removal of Magu as EFCC chairman

President Muhammadu Buhari and the Attorney General of the Federation, AGF, Abubakar Malami, have questioned the veracity of the application seeking the removal of the Acting Chairman of the Economic and Financial Crimes Commission, EFCC, Ibrahim Magu from office.

The Presidency had insisted that Magu remains the Chairman of the anti-graft agency despite the senate’s refusal to confirm him on two separate occasions.

Against this backdrop, two lawyers, named Ahmed Yusuf and Peter Asa asked the court to remove Magu and restrain the Presidency from “being able to forward his name a third time to the senate.”

Both lawyers contended that Magu’s continued stay as EFCC’s Chairman despite his rejection amounted to “an attempt by the Presidency to force him on the Senate.”

However, Buhari and the AGF, asked the court to dismiss the suit because it’s lacking in merit.

The objection was signed by the Solicitor-General of the Federation, Dayo Apata, Tijani Gazali and a team of lawyers.

In the objection, they argued that the applicants had no “locus standi” to file the motion.

“We humbly submit that a perusal of all the processes in the court’s file will reveal that the plaintiffs instituted the action wrongly as they do not possess the locus standi to institute same. The plaintiffs do not have sufficient interest in the determination of this matter.

‘’The plaintiffs’ civil rights were not breached by the defendants. The plaintiffs did not meet the necessary pre-condition to filing this suit,” the objection read.
