The prayers of the Union party of Nigeria, UPN brought before an Abuja Federal High Court were turned down yesterday as the court refused to grant an ex-parte order stopping the Independent National Electoral Commission from creating additional 30,000 polling units ahead the 2015 general elections.
The Judge, Justice Abdul Kafarati, however mandated the party to serve INEC the hearing notice so that the electoral body can make an appearance. The Judge said that is necessary because of the sensitive nature of the matter before him.
With this, INEC is expected to file its defence to the suit file by Mrs. Nella Andem-Rabana on behalf of the UPN, contesting the creation of additional polling units and asking the court to declare the exercise ultra vires, unconstitutional, null and void and of no effect.
