Frozen account: Appeal court reserves ruling on Fayose’s case

The Court of Appeal sitting in Ado-Ekiti on Thursday reserved ruling on an application filed by the Economic and Financial Crimes Commission, EFCC, praying the court to grant an injunction restraining Governor Ayodele Fayose from further dissipating and executing the lower court judgment which defreezed his account.

The Counsel to EFCC, Mr Rotimi Oyedepo told the court that the application, supported by seven paragraphs affidavit, was to restrain the respondents from further withdrawal from the account pending the determination of the substantive appeal.

Mr Oyedepo argued that by the rules of the court of appeal, the judges were empowered to make an injunction of such in the interest of justice.

Mr Oyedepo who cited order four rules 6 to buttress his argument, urged the court to grant the injunction.

However, counsel to Governor Fayose, Chief Mike Ozekhome (SAN) argued that an injunction cannot be granted in an already completed or partly completed matter, since the respondent enjoyed immunity.

Chief Ozekhome who asked the court to refuse the EFCC’s prayers, said the application failed because it did not show any cause of appeal.

DAILY POST reports that counsel to Zenith Bank Plc, Mr Oluwasgun Ayinde did not oppose the application as canvassed by the EFCC.

Justice Almed Belgore having listened to the argument of both parties, said he reserved ruling till a date that would be communicated to all parties in the matter.
