An Ibadan-based medical doctor, Olutunde Oni, has dragged First City Monument Bank (FCMB) before an Oyo state High Court sitting in Ibadan over an alleged issuance of counterfeit Euro currency to him.
In a suit numbered I/134/2017, Oni alleged that the bank through Folorunso Abisoye, sometime in 2015 through its Bodija, Ibadan branch issued him with Euro currency, among which a fake note was detected during a trip abroad.
In the affidavits deposed to, Oni recalled that he discovered the fake currency when he patronized a pharmacy in Germany in one of his trips and that he quickly contacted the bank to complain.
He lamented that he was briefly detained at a security station in Germany, where he made statements to explain his innocence.
On his return to Nigeria, Oni said he consulted his lawyer with a Certified True Copy (CTC) of the counterfeit currency and other documents to seek redress in the Nigerian court of law.
In court on Monday, the counsel, Ade Fajemiroye, urged Justice Boyede Akintola, to hear the case in default because the defendants failed to file their defence.
He added that the defendants had been served with all the court processes by the court bailiff.
But Justice Akintola, rejected the appeal of default hearing and listed the case for hearing on October 10, 2017.
She urged the claimant’s lawyer to serve the defendants to serve all the necessary papers even outside the court’s jurisdiction if need be.
“Let us serve them on time because you are serving outside the jurisdiction”, New Telegraph quoted Justice Akintola as ruling.
