Court throws out Obanikoro’s N100million suit against EFCC

A N100m human rights suit filed by former Minister of State for Defence, Musiliu Obanikoro, against the Economic and Financial Crimes Commission (EFCC), has been dismissed by the Federal High Court in Lagos on Monday.

Obanikoro sued the anti-graft agency, for unlawful invasion of his houses and seizure of property.

His lawyer, Lawal Pedro, urged the court to declare the items seized by the EFCC on June 14, 2016 null and void. He also urged the court to award N100m damages against the commission.

But in a ruling on Monday, Justice Abdulaziz Anka struck out Obanikoro’s suit for being incompetent.

Abdulaziz stated that the applicants’ houses were searched by the EFCC, based on search warrants obtained from the Lagos State Magistrates’ Court.

He, therefore, could not declare the recovered items as null and void.
