An industrial court sitting in Akure has dismissed an appeal of “stay of execution” filed by the management of the Rufus Giwa Polytechnic, Owo (RUGIPO) over the judgement of the 32 sacked workers of the institution.
It would be recalled that the same court had on September 30, this year ordered the reinstatement of 15 out of the 32 sacked workers of the Polytechnic, noting that only the employment of the 15 academic staff had “statutory flavor”
The court explained that employment of the remaining 17 workers lacked “statutory flavor” and was only based on “master servant relationship” with the institution.
However, the Polytechnic authority that was not satisfy with the ruling returned to the same court to file a stay of execution before embarking to appeal the judgement at the lower court.
But, the trial judge, justice Anthony Ubaka, in her ruling said that “stay of execution” could not be granted to the plaintiff because it was unmeritorious and against court order.
Counsel to the complainants, Mr Gabreal Omotayo Omo-edu said that the application of the defendant was demised for lack of merit.
He explained that the remaining workers would proceed to Court of Appeal with proper documents so as to press home their demands.
