Temporary respite came the way of recuperating Governor of Taraba State, Mr. Dambaba Suntai, as the medical panel set up by the Taraba State House of Assembly to determine the medical state of the governor, was today nullified by a Taraba State High Court sitting in Jalingo.
In a five hour judgement, Justice Silas Haruna said the setting up of the panel by the State Executive Council and the State House of Assembly amounts to usurpation of the judicial process.
The Judge said the governor already filed a suit challenging the decision of the state House of Assembly stopping him from resuming his duties as the governor of the state.
Suntai had filed a suit before the state High Court when the House of Assembly stopped him from resuming his duties after he had written a letter to the house intimating them of his desire to.
“There are two cases on this matter: one between Mr Bello Mustapha against Suntai at the Supreme Court and Suntai against the House of Assembly at the state High Court; both are served on the defendants.
“Their action of setting up the panel to investigate Suntai is thus a usurpation of the powers of the Supreme Court and the state High Court.
“It is, therefore illegal, null and void,” he said.
The Judge ordered parties in the suit not to take further action on Suntai until the substantive suits at various courts are determined. he also asked parties not satisfied with the ruling to appeal within 90 days of the judgement.
