Court dismisses PDP application on Card Reader

A Federal High Court sitting Abuja has ruled against the application that the Independent National Electoral Commission, INEC, be stopped from using the Smart Card Reader Machines for the presidential election holding tomorrow.

The ruling which held Friday afternoon as presided by Justice Ademola Adeniyi held that the court lacks jurisdiction to issue an interim order of injunction to top INEC from using the machine for the election.

Both INEC and the Attorney General of the Federation, Mohammed Bello Adoke, SAN, have been asked to appear before the court on April 24 to look at the legality or otherwise of the use of the card readers for a general election.

The court however held that if ‎it is eventually proven that the use of the card readers were illegal and unconstitutional, it will move annul the outcome of the general election even after the elections have been held.

DAILY POST recalls that the application was filed by a Senatorial candidate of the Peoples Democratic Party, PDP, in Ogun state,‎ Mr. Walihu Taiwo.
