The National Publicity Secretary of the Peoples Democratic Party, PDP, Chief Olisa Metuh on Thursday told a Federal High Court sitting in Abuja that he had no case to answer regarding the allegation of 400 million naira purportedly diverted to his account from the office of the then National Security Adviser, Sambo Dasuki.
This was contained in a no-case -submission filed by his lawyer, Onyechi Ikeazu before the court.
Ikeazu had informed the court that Metuh had filed a written address in respect to the no-case-submission.
Arguing that the defendant has no case to answer, IKpeazu said, “The defendant has filed a written address dated 18 february,2016, captioned No-case-Submission, we adopt and rely on the submission.”
Ikpeazu advised the court to adopt the No-Case-Submission, discharge and acquit the defendant at this stage of the case.
The prosecution led by Sylvanus Tahir in his response confirmed receipt of the No-Case-Submission and appealed to the court to order the defendant to enter defense.
Ruling on the matter, JUstice Okon Abang adjourned the matter till March 9 for either ruling or judgement.
Justice Abang held that if the No-Case-Submission filed by the defence succeeds, then the case will be struck out and the case dismissed.
He also held that the court will compel the defendants to tender his witnesses before the court.
