Appeal Court upholds Amosun’s victory


The election that brought Governor Ibikunle Amosun to power has been upheld by a Court of Appeal sitting in Ibadan

The five-man panel of the Appeal Court led by Justice H.M Ogunjimiju on Thursday unanimously upheld the judgement of the Governorship Election Tribunal on October 23 and dismissed the appeal filed by Mr Adegboyega Isiaka of the Peoples Democratic Party, PDP.

Justice Ogunjimiju noted that Benjamin Ibikunle, the Principal Witness, tagged PW9, for the appellant was not a credible witness, adding that his testimony could not be relied upon by the court.

The Judge held that the evidence of PW9 was biased and could not be relied upon because he testified that he was a member of PDP and could go to any length to ensure victory for his party.

He said that the report of the witness was inconsistent and that there was no doubt that he did not take part in the inspection of the electoral materials.

Ogunjimiju said that the witness indicated to the court that he was not an expert while his testimony indicated an opinion of an expert

The panel said the court could not give any probative value to the testimony of the witness because he was not an expert.

Ogunjimiju further said the court can only give probative value to an expert opinion, adding that the tribunal was right in dismissing the petition.

While declaring Amosun winner of the April 11 governorship poll in the state, the appeal dismissed the case for lack of merit.
