Appeal Court sitting in Akure, the Ondo State Capital, had this morning dismissed the appeal filed by the Action Congress of Nigeria , ACN, governorship candidate, Oluwarotimi Akeredolu, SAN, over the judgment of the lower court headed by Justice Andovar Kaka’n which upheld the victory of Governor Olusegun Mimiko.

The five-member appeal panel headed by Justice Garba Muhammed said the tribunal was right to have dismissed the petition of Akeredolu on the ground that the injection of names into the voters registrar as alleged by the ACN was a pre-election issue.

Although, the Appeal Court agreed that the injection of names into the 2012 voters registrar used for the election was illegal, it insisted that it was a pre-election matter which should have been treated earlier.

Relatively, the Appeal court is presently ruling on the petition filed by the PDP over Mimiko’s victory.
