APC rejects Tribunal’s affirmation of Fayose election, set to appeal

The All Progressives Congress, APC, in Ekiti State has hinted that it will appeal the judgment of Ekiti State Election Petition Tribunal sitting in Abuja, which dismissed its petition challenging the declaration of Ayodele Fayose of the People’s Democratic Party as winner of June 21, 2014 governorship election.

In a statement by the state Publicity Secretary the party, Taiwo Olatubosun, the party said it was dissatisfied with the ruling, which dismissed the petition based on the fact that the grounds of the petition were pre-election matters.

“Even though the tribunal did not say that all the issues raised against Fayose were not true, it dismissed the entire case on the basis of pre-election matter tag; it will now be challenged at the Appeal Court,” Olatubosun said.

APC recalled that before the election, an allegation of perjury was raised against the PDP’s candidate, who stormed the court to disrupt proceedings of the trial of the case, after the trial judge, Mr. Justice Segun Ogunyemi, judges, lawyers and other court officials were beaten and court records in the office of the Chief Judge were torn.

APC said “It is worrisome that the judiciary appears not ready to tackle the flagrant abuse of the courts by desperate politicians. An allegation of perjury was raised against Fayose before the election.

On the day a judgment was expected on the matter, Fayose stormed the court with his thugs to beat the judges, lawyers and other court officials. This forced indefinite suspension of the case and so the case could not be determined before the election”.

APC further called on the Nigeria Judicial Council (NJC) to save Nigerian Constitution by preserving the integrity of the judiciary.
