Alleged murder: Rivers PDP Chairman, Obuah runs to Appeal Court

Chairman of the Peoples Democratic Party, PDP in Rivers State, Bro. Felix Obuah has approached the Appeal Court to challenge decision of the High Court against him.

Justice Adolphus Enebeli of the High Court in Port Harcourt had dismissed Obuah’s application with Suit No. PHC/1249/2016, seeking a Perpetual Injunction to restrain the Police from investigating him.

Citing some Supreme Court precedents, Justice Enebeli said the police cannot be stopped from investigating any individual when a report of crime has been committed.

In the notice of Appeal obtained by DAILY POST, the Rivers State PDP Chairman said the High Court erred in its verdict by dismissing his application.

In the Appeal filed by Frank Onyiri on behalf of Obuah, the Appellant is asking the Appeal Court to set aside the decision of the lower court.

Meanwhile, Attorney General of Rivers State Emmanuel Aguma, SAN, had said Justice Enebeli did not make an order for the Police to arrest Obuah.

Aguma, in an interview with newsmen in Port Harcourt said Justice Enebeli only refused Obuah’s application for an injunction to restrain the Police from inviting him for questioning.

He also clarified that Obuah is not facing any criminal charge in connection with Don Waney’s killing.
