The Action Congress of Nigeria,ACN,and its Governorship candidate in Ondo state,Mr Oluwarotimi Akeredolu,SAN, have taken their battle of challenging the October 20 governorship election to the Apex Court with an appeal, and urging the Supreme Court to set aside the Appellate Court’s ruling which upheld the victory of Governor Olusegun Mimiko.
The Lower Court and the Appeal, both in Akure, the State Capital on May 3, and July 1, consecutively upheld the election of the last year October 20, in favour of the incumbent Governor, on the grounds that the petitioners evidences are not substantial enough to nullify the poll.
Confirming this through ACN’s Counsel, Charles Titiloye said the appeal against the judgement was filed during the weekend at the Supreme Court.
The complainants are challenging the Appeal Court’s ruling on 13 based grounds.
They observed that the Appellate Justices erred in law when they held that the Appellants failed to prove how non compliance of voters register used for the election, with electoral Act substantially affected the result of the election.
They noted that the lower Court’s findings that voters register used for the election did not comply with the statutory requirement render unnecessary any proof of how the non-compliance substantially affected the result of the election. It was also observed that the effect of the said ruling before the Court of Appeal is that there is no valid voters register for the election.
The Appellants noted that there were sufficient proofs before the Court to show that the non- compliance affected the result of the Election.
ACN and Akeredolu noted that learned Appellate Justices erred in law when they ruled that the appellants did not show how the judgment appealed and had occasioned substantial or miscarriages of Justice when the Appellate Court in his Judgment found many miscarriages of justices and injustices suffered by the Appellants which made the Tribunal to dismiss their petition.
They prayed the Supreme Court to nullify the Governorship Election held in Ondo state in October last year and order fresh election based on a Valid register of Voters.
The Appeal was filed by 52 lawyers led by Chief Akin Olujimi, SAN, Oladipo Okpeseyi SAN, Lasun Sanusi SAN and Oluwole Aina Esq.
