The Federal High Court sitting in Umuahia, Abia state, has dismissed a pre-election suit filed by Chief Emeka Utah, against the eligibility of Comrade Sunday Ajero as the House of Assembly candidate of the All Progressives Grand Alliance, APGA, for Umuahia North constituency of the state.
Delivering his judgment on Wednesday, Justice Daniel Osiagor said, “there is no doubt that based on the avalchance of documentary evidences before the court that the plaintiff participated and won the primary election held in Umuahia North constituency, it will be a mere academic exercise for the court to go on with the matter, as the plaintiff and defendant failed the House of Assembly election conducted by INEC on March 9, 2019 in Umuahia north state constituency”.
Recall that the applicant, Chukwuemeka Utah, in the Suit No FHC/UM/CS/99/had in exparte motion dated 25th October 2018 and filed on the 26th October 2018, sought an order of the honorable court granting leave to him to bring application for judicial review of the actions/conducts of respondent in the Umuahia North (Ohuhu) Abia state constituency primary election of the All Progressives Grand Alliance(APGA) – to wit prohibiting the respondents or their agents from replacing his name (the winner of the primary election) with the name of Mr. Ifeanyi Sunday Ajero.
