Abia 2019: Court nullifies Chikwe Udensi’s candidature, upholds Otti’s emergence as APGA flagb

The Federal High Court sitting in Umuahia has dismissed two separate suits filed by a faction of the All Progressives Grand Alliance (APGA) in Abia State, led by its chairman, Nnanna Ukaegbu.

Chief Ukaegbu had prayed the court in separate suits to grant his interim order by declaring him the legitimate chairman of the party in the state and also recognize the list of his faction, which brought about the candidacy of Chief Chikwe Udensi as the party’s gubernatorial candidate in the state.

However, the court struck out his suit, stating that it cannot support an interim injunction secured in 2014 being turned to a perpetual injunction now. Hence, the court granted a stay of execution of the order giving Ukaegbu impetus.

Also, on the issue of the court mandating INEC to recognize the candidate of its faction as the party’s candidate in the forthcoming election, the court ruled that it lacks the jurisdiction to entertain the suit.

Meanwhile, the Federal High Court in Umuahia, and presided by Justice E.N Anyadike, has fixed February 19 deliver judgement, in the suit filed by Chukwuemeka Utah, challenging the eligibility of Sunday Ajero, as the All Progressives Grand Alliance(APGA) House of Assembly candidate for Umuahia North constituency for the 2019 general elections.

The court also granted leave to the applicant (Utah) to serve the motion on notice and other processes in this suit on the respondents.

The court granted the order after going through the grounds of the application together with 33 paragraphs affidavit deposed to by Chukwuemeka Utah and written address of Counsel, Charles Okwudiri Esq.

In the suit no:FHC/UM/CS/99/, the applicant(Utah) had in ex parte motion, dated 25th day of October 2018 and filed on the 26th day of October, 2018, sought an order of the court granting leave to him to bring application for judicial review of the actions/conducts of respondent in Umuahia North(ohuhu), Abia state constituency primary election of the All Progressives Grand Alliance(APGA)-to wit prohibiting the respondents or their agents from replacing his name(the winner of the primary election) with the name of Mr. Ifeanyi Sunday Ajero.
