A Federal High Court sitting in Umuahia, and presided by Justice E.N Anyadike, has granted an order prohibiting the Independent National Electoral Commission,INEC, the national chairman of the All Progressives Grand Alliance,APGA, Victor Oye, Reverend Augustine Ehiemere and two other respondents or their agents from replacing or substituting the name of an applicant( Chukwuemeka Utah),with the name of Mr. Ifeanyi Sunday Ajero or any other person.
The court also granted leave to the applicant to serve the motion on notice and other processes in this suit on the respondents.
The court granted the order after going through the grounds of the application together with 33 paragraphs affidavit deposed to by Chukwuemeka Utah and written address of Counsel, Charles Okwudiri Esq.
In the suit no: FHC/UM/CS/99/, the applicant, Chukwuemeka Utah had in exparte motion, dated 25th day of October 2018 and filed on the 26th day of October,2018, sought an order of the honorable court granting leave to him to bring application for judicial review of the actions/conducts of respondent in the Umuahia North (Ohuhu) Abia state constituency primary election of the All Progressives Grand Alliance(APGA)-to wit prohibiting the respondents or their agents from replacing his name (the winner of the primary election) with the name of Mr. Ifeanyi Sunday Ajero.
The court, however, adjourned the matter to 26th November 2018 for commencement of hearing.
Meanwhile, the Abia state chapter of the AlI Progressives Grand Alliance, APGA, has stated that Chief Chukwuemeka Utah, remains the authentic House of Assembly candidate of the party for Umuahia north constituency for the upcoming 2019 election.
Rev. Augustine Ehiemere, the APGA chairman in the state, in a chat with newsmen in Umuahia, disclosed that Utah’s name had been submitted and sent to the Independent National Electoral Commission, INEC, stressing that the leadership of the party was waiting for the final publication of candidate’s names by the electoral umpire.
As at the time of this report, efforts to reach Mr. Ifeanyi Ajero, a House of Assembly aspirant for Umuahia north constituency during the just concluded APGA primaries in Abia state, for his reaction on the court order was unsuccessful.
